Juvare AEDT/AI Disclosure under Applicable Hiring Laws

Juvare may utilize artificial intelligence (“AI”) in connection with the assessment, evaluation, and/or hiring of job candidates. Such candidates may live in New York City, Illinois, Connecticut, and elsewhere. The AI we utilize may be an “automated employment decision tool” within the meaning of New York City Local Law 2021/144 or an “automated employment-related decision technology” within the meaning of Connecticut’s “Act Concerning Online Safety” (collectively, “AEDT”).

The AEDTs we use may utilize artificial intelligence for the purposes of hiring, promotion, renewal of employment, selection for training or apprenticeship, discharge, discipline, tenure, or the terms, privileges, or conditions of employment.

Employee and Applicant Privacy Notice for California Residents

This California Employee and Applicant Privacy Notice describes what personal information Juvare collects and processes in the employment and job application contexts. This Notice is only applicable for California residents that are Juvare current employees and contractors or job applicants to positions within Juvare (“Employees” and “Applicants” respectively).

Juvare processes personal information in connection with applications for employment and in the employment context as a part of our standard operations. We process this data to recruit, evaluate, and hire job applicants for Juvare positions, and once hired, we process personal data to provide employment, benefits, or other employment-related offerings. This Notice is addressed to Applicants and Employees where we determine the purposes and means of processing their personal data. This Privacy Notice does not apply to the processing operations of benefits providers or external parties who may process Applicant or Employee data for their own purposes. If you are an Employee or Applicant and have questions regarding how others process your personal data, please contact them directly or see their privacy notice(s).

Collection of Personal Information

Within the last 12 months, we may have collected the following types of personal information about Applicants and Employees:

  • Identifiers such as a real name, alias, postal address, unique personal identifier, online identifier, Internet Protocol address, email address, account name, Social Security number, driver’s license information, passport information, or other similar identifiers.
  • Personal information categories such as name, signature, Social Security number, physical characteristics or description, address, telephone number, passport number, driver’s license or state identification card number, insurance policy number, education, employment, employment history, bank account number, credit card number, debit card number, or any other financial information, medical information, or health insurance information.
  • Protected classification characteristics under California or federal law.
  • Biometric information such as fingerprints in digital or other form, or copies of your fingerprints in connection with our own or our customers’ (or prospective customers’) security or background checks, or used in order to access IT systems.
  • Internet or other similar network activity including browsing history, search history, information regarding interactions with websites or applications.
  • Geolocation data, including physical location.
  • Sensory data such as audio, electronic, visual, or similar information, including audio/visual recordings of meetings, interviews, or other correspondences.
  • Professional or employment information such as current or past job history or performance evaluations and other communications and information about job performance and assigned tasks.
  • Non-public information such as education records directly related to a student maintained by an educational institution or party acting on its behalf, such as grades or transcripts.
  • Inferences drawn from other personal information such as a profile reflecting a person’s characteristics, psychological trends, predispositions, behavior, attitudes, intelligence, abilities, and aptitudes.
  • Sensitive personal information (discussed further below).
  • Security clearance forms and associated information and details pertaining to security clearances, where relevant to employment or the evaluation of job candidates.
  • Information regarding workplace or other accommodations.
  • Information volunteered by an Employee or Applicant, such as through written correspondence with us, human resources complaints or investigations, through the interview process, or through employee assistance programs or counseling or treatment.
  • Medical or dietary information, including where required to respond to an emergency, or to cater company events.
  • Information regarding disabilities, race or ethnicity, and veteran status.
  • Information collected from or during discussions with listed references.
  • Information collected during a credit and/or criminal background check or drug screening. Background, security, and/or other employment-check information may include credit reports and information regarding bankruptcy or adverse legal actions for Employees in certain corporate departments, such as finance.
  • Information related to sanctions and similar screenings from government agencies.
  • Information relevant to work eligibility, immigration status or professional licensure, including documents pertaining to ability to work or perform various job functions, or where we may assist or apply on an individual’s behalf for a visa, license, or other similar documents.
  • Information you provide to us or to third parties we utilize to support job postings, recruitment, and interviewing for open positions, such as resumes, cover letters, or other job application documents or information.
  • Taxpayer identification number, and/or other, similar income tax and work authorization-related information.
  • Information related to public online activities that we may collect as a part of pre-employment screening or during employment, including information on public social media accounts or profiles.
  • Contact information of spouses or other family members for use in the event of, e.g., an emergency.
  • Health information we collect as a part of pre-employment health/medical screening or health screenings or other services provided during employment.
  • Records relating to your use of any information technology systems we provide or manage. This may include details relating to the use of personal devices if such devices are connected to our systems in relation to our Bring-Your-Own-Device policy.
  • Your billing history on any Company-issued credit card, and/or any other expenses you submit to us for reimbursement.
  • Photographs, for example, if we take photographs for an ID card or company directory, at a company social function, for company promotion or website listing, or for another, similar business purpose.
  • We may monitor Employee and/or Applicant electronic activity on Juvare devices, or over Juvare networks, to detect and respond to threats to other individuals or our network, intellectual or physical property, reputation, or business.
  • Information necessary to provide Employees, dependents, and/or designated beneficiaries with employment benefits, including names, addresses, and Social Security numbers, and records of benefits, claims, and payment history.
  • Movements and actions in our facilities, as captured by the use of ID cards to access locked areas or our security cameras. This may include audio/video capture.
  • Other information as may be reasonably required in the course of employment with us, as required by law, or for which we have obtained consent.

Collection of Sensitive Personal Information

Some of the categories of Employee and Applicant personal data collected by Juvare as detailed above may be considered “sensitive” personal data under California law. This can include:

  • Social Security, driver’s license, state identification card, or passport number.
  • Account log-in or financial account information in combination with any required security or access code, password, or credentials allowing access to a Juvare-provided or administered account.
  • Precise geolocation.
  • Racial or ethnic origin, citizenship or immigration status.
  • The contents of mail, email, and text messages.
  • Biometric information including fingerprints.
  • Information about health.
  • Information concerning sexual orientation.

How We Collect Employee and Applicant Personal Information

We collect Employee and Applicant personal information from the following sources:

  • Directly from Employees and Applicants when provided to us, e.g., when applying for a job.
  • From other persons, e.g., from co-workers and managers, former colleagues, references, from business contacts, clients, vendors, customers, professional references, our background check provider (currently Sterling); and other sources.
  • From our affiliates, investors, business associates, or partners, for instance when recommending talent to us.
  • From other third parties, such as HR platforms, health clinics, recruiters/referral networks, educational institutions, job boards, social media, other digital venues where we post jobs and recruit, and artificial intelligence service providers we utilize during the recruitment, applicant screening, and hiring process.
  • Automatically when using our telephone system, or IT infrastructure, or via audiovisual surveillance or access control systems when individuals are physically present in our facilities.
  • Automatically as individuals interact with our websites. We may receive information in connection with content, cookies, widgets, components, or other tools deployed on our websites, including from third parties. To the extent that individuals access our web site as a visitor, see our Privacy Notice for a description of how our website collects information.
  • From our customers or prospective customers. In some cases, our customers or prospective customers may conduct or direct their own background or security checks (for example if our customer is a government agency who requires a security clearance). We may receive information from the relevant customer or their designee in connection with such a review.
  • From the government or its agents (e.g., in connection with evaluating immigration status or right to work).
  • From staffing agencies (e.g., if individuals are hired through a staffing agency).
  • From sanctions screening, background and other checks, including in evaluating continuing work suitability.
  • From other third parties we interact with in pursuit of human resources-related goals, for example, employment benefits providers.

How We Use Employee and Applicant Personal Information

We may use personal information of Employees and Applicants for the following purposes:

  • To facilitate the employment relationship, e.g., to provide employment and benefits.
  • To recruit, evaluate, make or decline offers to, and hire Applicants.
  • To recruit, search, sort, screen, or evaluate applicants using artificial intelligence.
  • To fulfill our tax and compliance obligations, including as an employer.
  • For public relations, media, and other public disclosures.
  • To monitor productivity, including remote work productivity, and to evaluate and improve the quality of the work performed for us.
  • To make accommodations for disabilities.
  • To seek to provide a safe and ethical workplace, to protect our data, information technology, intellectual property, and facilities, and to investigate and protect against violations of company policies/procedures or possible insider threats.
  • To evaluate suitability for positions, duties, or continued employment with Juvare.
  • To determine and administer and support professional disciplinary actions, up to and including termination and post-termination activities.
  • To prepare for or protect and defend against actual or potential legal claims or for other, related legal purposes.
  • To pay Employees.
  • For insurance or auditing purposes or for mergers and acquisitions diligence.
  • Hosting events/retreats and/or managing and reimbursing expenses.
  • Managing HR functions, coordinating work, as part of reviews/feedback from customers or others, managing our business, and/or monitoring IT usage.

  • For other purposes relevant to operating our business consistent with the disclosures and description in this Employee and Applicant Privacy Notice for California Residents, as permitted by law, or for which we have obtained consent.

Disclosure of Personal Information

Please see Appendix 1 below for information about the categories of Applicant and Employee personal data we have disclosed in the last 12 months, as well as information about the recipients of such data.

Sales of Employee and Applicant Personal Information

Individuals, including Employees and Applicants, who interact with our website may be subject to data collection and disclosures referenced in our Privacy Notice. In the last 12 months, such disclosure includes disclosures for online analytics, marketing, and/or advertising purposes which may be considered a “sale” or “sharing” of personal information under California law. For Employees and Applicants, we may additionally “sell” or “share” your information in connection with the operation of productivity monitoring tools, digital analytics or screen recording tools (such as may be deployed on our intranet), or with benefits providers. See Appendix 1 for more information about the categories of personal data that may be subject to such disclosures. We do not sell the personal information of individuals who we know to be under 16 years of age. Please see the “California Privacy Rights” section below for more information. To exercise the right to opt out of personal data sales, individuals may submit a request by visiting our Do Not Sell or Share My Personal Information page.

Data Storage and Retention

We generally retain the personal information of our Employees for at least twelve (12) months following the end of the relevant Juvare Employee’s tenure with us. We may maintain personal information of Employees and Applicants until the purpose for its collection has been fully completed, including the purposes described in the How We Use Employee and Applicant Personal Information section above. If an individual consents to a new or additional purpose for retaining their data, such personal information may be stored for longer.

California Privacy Rights

California residents have the following rights regarding their personal information:

  • Right to Know/Access. Individuals have the right to know what personal information we have collected about them, including:
  • The categories of personal information we have collected about them;
  • The categories of sources from which the personal information was collected;
  • The business or commercial purpose for collecting, selling, or sharing personal information;
  • The categories of third parties to whom we disclose personal information; and
  • The specific pieces of personal information we have collected about them.
  • Right to Delete. Individuals have the right to delete personal information that we have collected from them, subject to certain exceptions.
  • Right to Correct. Individuals have the right to correct inaccurate personal information that we maintain about them.

Employees and Applicants have the right not to be retaliated against for exercising privacy rights conferred by California law.

Individuals may designate an authorized agent to make a request to know, request to correct, or request to delete on their behalf. An agent may be an individual or a business entity. To designate an authorized agent, individuals must provide the agent with written permission to submit the request. We may still require direct identity verification (subject to certain exceptions). We may refuse a request if the agent does not provide adequate proof of their authorization. We may limit our response to rights requests as permitted by law.

3. Australia/New Zealand Employment Terms

Juvare generally collects personal information directly from you when you apply for employment with us.

If you apply for a job with us, we may also collect your name, contact details, academic records and qualifications, job history, criminal record and background checks (including information necessary to validate your identity, right-to-work validation, address, driver’s license, criminal record, employment and education verification, professional qualifications, references, and civil litigation and bankruptcy history), information contained in a resume, and other information you choose to provide in connection with applying for a job.  Juvare generally collects this information directly from you but may, with your authorisation, collect information relating to: (a) criminal records and background checks, identity verification, and employment and education verification information from third parties (such as Government agencies, identity verification providers and education institutions), and (b) your character and previous employment history and performance from referees nominated by you, for the purposes of enabling Juvare to assess your suitability for a particular role and facilitating any ongoing employment relationship with you.

Juvare does not mandate the provision of your personal information, the provision of which is voluntary. However, in some cases, if personal information is not provided to us, this may impact our ability to consider you for, or offer you, employment opportunities.
